1. General provisions

This Cookie Policy explains how S.R.L. “BPM-TRADE”, hereinafter referred to as the “Company”, uses cookies and similar technologies through the website https://bpm.md/, the purposes for which they are used, and the options available to users to manage their preferences.

This Policy applies to all persons accessing the website, including all its pages and language versions, and supplements the Company's Privacy Policy.

The use of cookies and the related processing of personal data are carried out in compliance with Law No. 195/2024 on Personal Data Protection and other applicable legislation of the Republic of Moldova.

2. What are cookies?

Cookies are small files consisting of letters and numbers, stored by the browser on the user's device — computer, mobile phone, tablet or other equipment — when the user accesses a website.

They make it possible to remember certain choices, manage a session, retain information necessary for specific functionalities, or recognise a device through an identifier.

Cookies are not executable programs and do not, in themselves, constitute viruses. Information stored in cookies may be read by the website or service using them, subject to the browser's security rules.

Similar technologies include browser local storage and other mechanisms for storing information or recording interactions. This Policy also applies to such technologies, depending on the purpose of their use.

Information enabling the direct or indirect identification of a natural person, including through online identifiers, constitutes personal data.

3. Why do we use cookies?

Depending on the services implemented, the Company uses cookies and similar technologies to:

• ensure the proper and secure functioning of the website;

• remember cookie choices;

• manage technical sessions;

• retain selected products in the shopping cart;

• operate the mechanisms required to submit enquiries and orders;

• remember browsing preferences;

• analyse traffic and improve website performance;

• prevent unauthorised access and abusive activities;

• display embedded content from third-party providers;

• measure campaigns and use marketing services, where implemented and accepted by the user.

Cookies are used only for the stated purposes. Analytics or advertising tools are not considered strictly necessary merely because they are useful to the Company.

4. Types of cookies

a) Strictly necessary cookies

These cookies are indispensable for the website's essential functions or for providing a function requested by the user.

They may support session security, the storage of cookie choices, retention of products in the shopping cart, and the operation of mechanisms required for enquiries or orders.

They are not used for advertising or optional browsing tracking and cannot be disabled in the “Cookie Settings” panel. Blocking them through the browser may affect the relevant functions.

Where personal data are involved, the legal basis is determined according to the specific purpose: steps requested by the user prior to entering into a contract or performance of a contract, or the legitimate interest in security, technical operation and respecting user choices.

b) Preference cookies

Where implemented, these cookies remember additional choices, such as language or display settings.

Preference cookies that are not strictly necessary for the requested service are optional, disabled by default and used on the basis of consent.

c) Analytics and performance cookies

Where implemented, these cookies enable measurement of visits, pages accessed, traffic sources and interactions in order to improve the website's content and operation.

Optional analytics cookies are activated only after consent has been given. Aggregation of results does not automatically mean that the data originally collected are anonymous.

d) Marketing cookies

Where advertising services are implemented, these cookies may be used to measure campaigns, personalise advertising and limit the frequency of advertisements.

They are optional and are activated only with the user's consent.

e) External content

Embedded materials from third-party providers, such as maps, videos or documents, may result in the transmission of technical data and the use of the providers' cookies or identifiers.

The “Cookie Settings” panel displays only categories corresponding to services actually used.

5. Cookie storage periods

Cookies may be:

• session cookies, whose existence is linked to the browsing session or to the period set for that session;

• persistent cookies, retained until the established period expires or until deleted by the user.

Their duration must be limited to the period necessary for the intended purpose. For each cookie, the website's inventory must specify its name, domain, provider, purpose, category and duration, including any renewal conditions.

The duration of a cookie on a device is distinct from the period for which data are retained on servers. Retention of personal data is also explained in the Privacy Policy.

6. Consent to the use of cookies

Upon the first visit, the user is shown a banner through which they may accept optional cookies or access “Cookie Settings” to select or reject the available categories.

If the panel requires a choice before browsing can continue, both acceptance and rejection allow access to the requested page. The Cookie Policy and Privacy Policy may be consulted before a choice is made.

Strictly necessary cookies remain active. Optional categories are disabled by default and are activated only after consent has been given.

Continuing to browse, closing the banner or taking no action does not constitute consent.

Rejecting optional cookies does not prevent access to the main information, use of functions necessary for the shopping cart, or submission of an enquiry or order.

The Company maintains appropriate records to demonstrate consent, in accordance with data minimisation requirements.

Choices apply to the bpm.md website and do not automatically constitute consent for other Company websites or external platforms.

7. Managing and disabling cookies

Users may change their choices and withdraw consent at any time through the “Cookie Settings” panel, which is permanently accessible on the website.

Withdrawal is as easy as giving consent and stops future processing based on consent, without affecting the lawfulness of processing carried out previously.

In addition, depending on the application used, the browser allows cookies to be viewed, deleted and blocked.

Blocking strictly necessary cookies may affect functions that depend on them. Changing a choice on the website does not automatically change the user's preferences on external platforms.

8. Third-party services and cookies

The website uses Google Tag Manager to manage tags. The data and cookies used depend on the services configured through it. The mere presence of Google Tag Manager does not mean that Google Analytics, Google Ads or other analytics or advertising services are used.

The services and cookies actually used must be identified in the website's inventory and reflected in its cookie settings.

The website may include embedded services or links to external platforms, such as:

• Google Drive, to access the Company's presentation, including through an embedded preview, where available;

• YouTube, to access video materials through links or materials embedded in a page;

• WhatsApp and Viber, to contact the Company;

• Telegram and other social networks or communication applications, if such links are added to the website.

Loading material or a service embedded in a website page may transmit technical data and trigger the use of the provider's cookies or identifiers. Optional services for which consent is required are loaded only after the corresponding choice has been made. Rejection may prevent display of the relevant material without blocking access to the website's main information.

Opening an external link is different from loading a service embedded in a website page. After following the link, the user may be redirected to the provider's website or application, where that provider's notices and settings apply. Cookie preferences selected on bpm.md do not automatically change the user's settings on external platforms.

Submitting an enquiry or order through services available on the website is distinct from accepting optional cookies. Providers' policies supplement the information provided by the Company and do not replace the Company's obligations regarding its own processing activities.

Providers' privacy notices:

• WhatsApp: WhatsApp Privacy Policies;

• Viber: Viber Privacy Policy;

• Telegram, if a link to this platform exists: Telegram Privacy Policy.

For other social networks or external platforms accessible through the website, users may consult the privacy policy published by the relevant provider.

9. Protection of personal data

Personal data collected through cookies and similar technologies are processed in accordance with Law No. 195/2024 and the Privacy Policy.

For processing based on consent, Article 6(1)(a) and the conditions set out in Article 7 of that Law apply.

The Company implements technical and organisational measures appropriate to the risks to protect data against unauthorised access, loss, alteration or unauthorised disclosure.

Subject to the conditions prescribed by law, users have rights of access, rectification, erasure, restriction, portability and objection, the right to withdraw consent, and the right not to be subject to decisions based solely on automated processing in cases provided for by law.

Requests should be sent to info@bpmplus.md. The Company responds without undue delay, in principle within one month, subject to extensions permitted by law.

10. Changes to the Cookie Policy

The Company updates this Policy when the services, website configuration, purposes of processing or legal requirements change.

The updated version is published on the website, indicating the date of the last update.

Where changes require new consent, publication of the Policy does not replace obtaining that consent. The relevant processing begins only after the corresponding choice has been made.
